Mediation is a process where the parties can attempt to amicably settle the pending issues in their divorce, or even child related issues that occur after the divorce is finalized. Mediation may be voluntary or court ordered. In Illinois, if mediation is court ordered, the parties are required to spend 4 hours in mediation to attempt to resolve issues related to their children.

Generally, the mediator is a licensed attorney who has training in mediation. The attorney is neutral and does not represent either party. The job of the mediator is to help the parties reach a settlement in an amicable fashion which is better for the parties and the children.

When looking for a mediator, it is important to make sure that the attorney has experience in family law and mediation in the jurisdiction where you and your spouse live. This ensures that the mediator has a strong grasp of the local rules and customs.
